Environmental regulation of mining

The department is planning and implementing activities for the commencement of the new environmental (mining) licensing framework established under the Environment Protection Legislation Amendment Act 2023.

On 15 February 2024 Government Gazette No. G4 was published stating commencement of the new environmental as 1 July 2024 laws.

Preliminary consultation with key stakeholders on draft risk criteria and standard conditions for exploration and extractive industries will shortly commence. The department will be contacting relevant stakeholders shortly to discuss opportunities for engagement and input into these important regulatory instruments. The department has published some preliminary information about environmental (mining) licences, transitional arrangements relating to the introduction of new laws, and the framework’s risk criteria and standard conditions.

An indicative timeline for developing the risk criteria and standard conditions has been identified

  • February to April 2024 - consultation with industry and key stakeholders
  • April to May 2024 - publication of draft risk criteria and standard conditions on Have Your Say (minimum 30 business days)
  • June 2024 - publish a summary of the feedback received
  • July 2024 - ministerial declaration, approval and publications of finalised risk criteria and standard conditions.
